Background

In 2006, Stewart completed his Juris Doctor at the University of Denver Sturm College of Law. Stewart holds both a Masters of Business Administration and Masters of Science in Management from the University of Denver Daniels College of Business.  Prior to graduate school Stewart completed his B.A. in History at the University of Colorado in Boulder. In 2008, Stewart founded the Cables Law Office, P.C., and in 2011 joined Jared K. Hassan to form Hassan + Cables. Stewart specializes in general business representation, state and Federal criminal defense, complex civil litigation, and employment law.

General Counsel, Civil Litigation, and Complex Employment Experience

As founding partner of Hassan + Cables, LLC, Stewart has vast experience in all aspects of complex commercial civil litigation including successfully representing clients in mediation, arbitration, evidentiary hearings, trial, and in state and federal courts. 

While Stewart predominately represents clients in the State of Colorado, he has been admitted to specific federal courts or Pro Hac Vice in Arizona (where he is licensed), Florida, Idaho, New York, Texas, Washington, and Wyoming. With 20 years of litigation experience and emphasis on achieving his clients' specific business goals, Stewart also serves as outside general counsel to several Colorado companies, ranging in size from start-ups to $20,000,000 per year in annual revenue.

Federal Criminal, Civil, and Environmental Defense

Beginning in 2007, Stewart began working for clients in the automotive industry, acting as General Counsel for ATS Diesel Performance. Around this time, the U.S. Environmental Protection Agency (EPA) mandated new emissions control systems on all certified diesel vehicles manufactured for sale in the United States. From 2008-2012, Stewart attended rulemaking sessions related to EPA and State of California's Air Resources Board mandates, technical courses related to the function of those systems, and developed invaluable hands-on experience with diesel trucks and the functionality of the mandatory and ancillary diesel emissions systems (DOC, SCR, DPF and OBD).

Around 2015, following the Volkswagen Dieselgate scandal, the EPA began to initiate civil and criminal investigations under the Clean Air Act against companies which allegedly tampered with a vehicle's emissions controls. In June 2019, the EPA created a National Compliance Initiative to prioritize the Agency's resources on after market defeat devices. Many companies which were being investigated by the EPA retained Stewart to defend against the enforcement actions and, ultimately, negotiate dismissals or settlements for those cases.

Stewart now spends much of his time advocating for clients who have allegedly violated the country's most complex civil, criminal, and environmental laws. Many of these cases include allegations of criminal conduct by the U.S. Department of Justice and the EPA's Criminal Enforcement Division (CID) or Environment and Natural Resource Division (ENRD). Stewart also defends his clients against EPA's civil and administrative enforcement efforts, and advises companies around the country regarding compliance with the Clean Air Act, and various state and local regulations.

  • Federal Civil (monetary) Enforcement efforts of individuals and companies on behalf of the DOJ's Civil Division (Subpoena responses, Answers, discovery production and review, depositions, Motions, trials).

  • Federal White-Collar and Environmental Criminal cases by US DOJ against companies and individuals (white-collar crimes, conspiracy, smuggling, and environmental crimes, such as violation of the CAA, tampering, after market defeat device sales and installation).

  • Administrative Enforcement against interested parties (Respond to Requests for Information, document production and review, negotiate administrative/civil penalties).

  • State Administrative and Criminal defense and enforcement efforts (e.g. California Air Resources Board (CARB) responses, document production and review, negotiate administrative/civil penalties.)

  • Counsel and professional advice on compliance with the Clean Air Act.

Representative Cases

  • USA v. Owens, Et. Al., (EDWA): Successful defense of a shipping company owner and the company, resulting in full dismissal of charges who had faced several felonies under the Clean Air Act, securing a dismissal of all charges after grand jury handed down an indictment and eighteen-month District Court defense.

  • USA v. Krech, (D WY): Successful defense of a diesel shop owner who had faced several felonies under the Clean Air Act, securing a dismissal of all charges in the interests of justice.

  • USA v. Huneycutt, (NDTX):  Successful defense of a diesel shop owner who had faced several felonies under the Clean Air Act, securing a dismissal of all charges in the interests of justice.
